本个人隐私政策主要向您介绍讯小通个人隐私政策(以下亦称“本政策”)相关说明,我们深知个人隐私对您的重要性,也感谢您对我们的信任,并会尊重保护您的个人信息公告的。您浏览我们【讯小通】APP或使用我们的服务时,我们将按照《【讯小通】APP个人隐私保护政策》(以下称“本政策”)收集、存储、使用及共享您的个人信息。同时,我们会通过本政策向您说明,我们如何为您提供访问、更新、控制和保护您个人信息的服务。本政策与您使用我们的服务密切相关,我们建议您仔细阅读并理解本政策全部内容,做出您认为适当的选择。我们努力用通俗易懂、简明扼要的文字进行表达,并对本政策中与您的权益存在重大关系的条款以粗体字形式进行标注以提示您注意。请您务必认真阅读本政策,在确认充分了解并同意后使用我们【讯小通】APP。您使用或在我们更新本隐私政策后继续使用我们的【讯小通】APP或服务时,即意味着您同意本隐私政策(含更新版本)内容,并且同意我们按照本隐私政策处理您的相关信息。如您不同意本隐私政策或其中的任何条款,您可以选择停止注册或停止使用或注销【讯小通】APP,同时【讯小通】APP将无法再为您提供相关服务。

如您使用我们【讯小通】APP提供的某项或某几项服务有其单独的隐私政策的,该服务对应的隐私政策将与本隐私政策一起构成一份完整的隐私政策。

本政策所称个人信息,是以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息,不包括匿名化处理后的信息。我们【讯小通】APP中与您个人无关的信息不属于您的个人信息。

本政策所称个人敏感信息,是指一旦泄露、非法提供或滥用可能危害人身和财产安全,极易导致个人名誉、身心健康受到损害或歧视性待遇的个人信息:个人财产信息(银行账户、资金及存款信息、资产信息、信贷信息、征信信息、交易记录、流水记录、虚拟财产信息)、个人健康生理信息(生病医治相关记录)、个人生物识别信息(基因、指纹、面部识别特征)、个人身份信息(身份证信息、护照信息、工作证信息),以及其他符合上述特征的个人敏感信息(通信记录、通讯录、精准位置信息)。

为使您正常使用我们【讯小通】APP服务,我们需要按照相关法规要求进行实名制管理。我们收集、存储、使用及共享您的个人信息,系出于遵守国家法律法规的规定,并为了向您提供服务及提升服务质量(如开发新产品或完善已有产品功能,以为您提供和推荐更为优质或适合的服务)的需要。

我们将严格按照《网络安全法》、《数据安全法》、《个人信息保护法》等相关要求,做好对客户信息采集、记录、存储及报送工作。

一、我们为何收集您的个人信息

(一)收集并保存的信息

我们收集并保存的您的个人信息包括:

1.您注册、登录手机号码、登录IP地址、手机IMEI码、版本、设备识别码、设备标识、登录日志。

2.您的使用记录,包括您的搜索记录、应用版本信息、您的剪切板数据及其他相关日志信息。

3.您主动提供的信息,包括您在我们【讯小通】APP主动发布的信息、您与客服联系时提供的信息、您参与问卷调查时填写的信息、您参与平台活动提供的信息、您使用平台填写相关申请提供的信息。

4.当您在使用我们的讯小通即时通讯服务时,因本APP为公司内部研发,仅为员工公司内部工作沟通交流使用,且仅允许发送工作相关内容,不允许运用于私人聊天等,为了增强公司资讯安全,以免泄露公司重要资讯(例如新产品设计等),其所有聊天记录将会被记录存盘,以备本公司权限人员查询或本公司客户权限人员查询。

5.我们在收集、使用您个人信息的过程中遵循权责一致、目的明确、选择同意、最少够用、公开透明、确保安全及主体参与原则。

6.讯小通通过合法途径从商业伙伴处或第三方取得的数据。例如在法律允许的情况下,我们会从公用和商用第三方来源获取有关数据来支持我们的服务;

7.个人常用设备信息(包括设备序列号、硬件型号、设备 MAC 地址、操作系统类型、应用列表(应用名称、应用包名、安装时间)及进程信息、唯一设备识别码 IMEI/AndroidId/OAID/IDFA/OPENUDID/GUID、SIM 卡 IMSI 信息等在内的描述个人常用设备基本情况的信息);个人位置信息(包括行程信息、精准定位信息、经纬度、IP地址、WLAN热点、基站信息、蓝牙设备以及其他能够用于定位的传感器信息等);个人设备权限信息(包括相册、相机、麦克风、通讯录、日历等信息)。

8.通常情况下,您不需要提供个人数据就可以浏览讯小通的对外公开信息。为了给您提供服务,讯小通会按照本隐私政策的规定保护、使用和披露您的个人数据。为服务之目的,如果您以自愿填写的方式或根据要求提供所需的个人信息,例如姓名、性别、证件种类及证件号、出生年月日、国籍、电子邮件信箱、电话、联系地址和邮政编码、所希望提供的服务或喜好信息、客户代码以及其他类似的个人数据,则表示您已经了解并接受讯小通依照本隐私政策对您的个人数据的收集、保护和使用。

我们收集并保存的您的非个人信息包括:

1.在使用我们提供的服务时您所发布、公布的信息;

2.讯小通已对您采取的包括但不限于违反法律法规规定或违反讯小通政策的处理措施等相关信息;

我们会尽力隔离您的个人数据和非识别性数据,并单独使用这两种数据。如果个人数据掺杂了非识别性数据,依旧会被视作个人数据处理。

未经讯小通事先同意,您不应向我们提供讯小通未明确要求的、可能致使讯小通在本政策之外被附加额外法律义务的个人信息。

为您提供安全保障

为了保障您的账号安全,以及系统运行安全,满足法律法规和我们协议规则相关要求,在您访问及使用我们的产品/服务过程中,经您授权我们会获取您的设备信息,包括您使用的设备型号、硬件序列号、设备MAC地址、IMEI、Android ID、GUID、SIM卡IMSI、移动应用列表、电信运营商特征信息。未经您的授权,我们不会提前获取以上信息。

为提高您使用我们提供服务的安全性,更准确的预防钓鱼网站欺诈和木马病毒,我们会使用或整合您的个人信息以及我们的关联方、合作伙伴取得您授权或者依法共享信息,根据您的使用习惯和常用软件信息来综合判断您的账号交易风险,包括验证身份、预防、发现、调查可能存在的欺诈、网络病毒、网络攻击安全风险。以保护您、其他用户、我们或关联方的合法权益。

(二)收集的目的

出于下列原因的考虑,我们收集并使用您的个人信息,您主动提供相关信息或要求您提供相关信息。前述信息的来源包括:您通过我们【讯小通】APP或其他合法途径向我们提供的信息;您自行向社会公众公开的信息;您通过合法公开渠道(如合法的新闻报道、政府信息公开)披露或合法留存于第三方的信息。

1.为便于您注册、登录、使用我们【讯小通】APP的各项服务

① 当您注册、登录我们【讯小通】APP及使用相关服务时,您可以通过手机号码创建账号,并且您可以完善相关的网络身份识别信息(头像、昵称、密码),收集这些信息是为了帮助您完成注册并使用相关服务。

② 在您使用我们【讯小通】APP推送服务,应用更新功能时,APP会开启自启动权限,若您不授权,不影响您其他功能。

③ 基于我们与通信运营商的合作,当您使用我们【讯小通】APP的“注册/登录”功能时,经过您的同意,我们会通过您的手机号码向通信运营商授权的第三方提交认证,以便我们为您提供快捷的登录服务。如果您拒绝提供将无法使用“注册/登录”方式注册登录我们【讯小通】APP,但不影响您通过其他方式注册登录,也不影响其他功能的正常使用。

④ 开展内部审计、数据分析和研究,改善我们的产品和服务。

⑤ 改善我们的防损和反欺诈计划

⑥ 遵从和执行适用的法律法规要求,相关的行业标准或我们的政策

⑦ 其它为向您提供服务而需要使用您个人数据的情形

2.风险防范

为了防止您个人信息及其他重要信息或资料被不法分子获取,我们需要收集您的下列信息以判断您账户的风险:当您访问我们【讯小通】APP时,我们可能会记录您使用的服务类别和方式、使用服务时的操作信息,您的IP地址、所使用的软件版本、设备识别码、设备标识符、您的地理位置及/或其他与我们【讯小通】APP服务相关的日志信息。如您选择关闭收集位置功能,我们将停止对您的位置信息的收集;这样做不会影响您进行交易,但可能会影响我们对安全状况的判断效果。

3.提供服务状态通知及查询服务

在遵守相关法律法规及监管规定前提下,我们会将您使用我们【讯小通】APP服务时的身份信息、行为信息进行存档,并严格按照法律法规的规定对前述信息进行妥善保管。为使您知晓使用我们【讯小通】APP服务的状态,我们会根据相关信息向您发送服务状态通知。

4.法律法规、监管规定允许的其他用途。

5.其他情形

在法律法规允许的范围内,我们可能会在出现以下任一情形时收集并使用您的个人信息而无需征得您的授权同意:

① 与国家安全、国防安全直接相关的;

② 与公共安全、公共卫生、重大公共利益直接相关的;

③ 与犯罪侦查、起诉、审判和判决执行直接相关的;

④ 出于维护个人信息主体或其他个人的生命、财产重大合法权益但又很难得到本人同意的;

⑤ 所收集的个人信息是个人信息主体自行向社会公众公开的;

⑥ 从合法公开披露的信息中收集个人信息的,如合法的新闻报道、政府信息公开渠道;

⑦ 根据个人信息主体要求签订和履行合同所必需的;

⑧ 用于维护所提供的产品或服务的安全稳定运行所必需的,例如发现、处置产品或服务的故障;

⑨ 个人信息控制者为新闻单位且其在开展合法的新闻报道所必需的;

⑩ 法律法规规定的其他情形。

二、我们如何使用您的个人信息

1.未经您事先同意,【讯小通】APP承诺不会出售您的个人数据。讯小通会在法律允许的范围内根据本政策使用您提供的个人数据。但讯小通可能会根据法律法规、司法机构、执法机构、监管机构或政府部门的要求向这些部门提供您的个人数据;或在诉讼、仲裁等法律或争议解决程序中披露;或在讯小通有理由认为有必要这样做来保护讯小通、客户或公众利益时,也可能在尽可能小的范围内公开某些个人数据。在您提供个人数据时,您理解并同意讯小通将在某些情形中使用或向第三方提供您的个人数据,包含但不限于如下情形:

① 根据法律法规的有关规定,或者应行政或司法执法及监管机构的要求,向第三方或者行政机关、司法机构、执法机构或监管机构披露;

② 如您出现违反所适用的法律、法规或者讯小通服务协议或相关政策的情况,需要向第三方披露;

③ 为向您提供或因您使用您所订购或要求的产品和服务,而需要向第三方披露;

④ 其它讯小通根据法律、法规或者网站政策认为合适的披露,例如出于执行条款与条件或为阻止人身、财产损失或非法行为的目的;

⑤ 除非得到您的许可,或本政策约定的其它情形,或因该第三方作为讯小通的服务提供商/分包商/授权中心向您提供服务,讯小通不会向无关第三方提供、出售或出租您的个人数据。

⑥ 在某些管辖区,如果涉及到重组、合并或破产或清算,可能需要披露您的个人数据;

⑦ 网络链接信息可能被用于网络攻击检测;

⑧ 在诉讼、仲裁等法律或争议解决程序中。

⑨ 在有公司资讯安全事件的情况下,我们可能需要向监管单位(含客户、政府机关等)提供聊天记录,这可能会涉及到披露您的部分个人数据。我们将确保在符合相关法律法规的前提下,谨慎处理此类请求,并尽最大努力保护您的隐私权益。

三、我们如何存储及保护您的个人信息

(一)我们在中华人民共和国境内收集和产生的个人信息将存储在中华人民共和国境内。若为处理跨境业务且经您授权而向境外机构传输境内收集的相关个人信息的,我们会按照法律、行政法规和相关监管部门的规定执行,并通过签订协议有效措施要求境外机构为所获得的个人信息保密。

(二)我们承诺将按照业内成熟的安全标准,采取相应的安全措施使信息安全保护达到合理的安全水平,并从制度设置、技术措施、人员管理多方面保障您的信息安全。

1.制度设置

我们通过建立数据分类分级制度、数据安全管理规范来管理规范个人信息的存储和使用,并建立信息保护专职岗位、数据安全应急响应组织来推进和保障个人信息安全。

2.技术措施

① 我们致力于使用各种网络安全层软件(SSL)进行加密传输、信息加密存储、严格限制数据中心的访问、使用专用网络通道及网络代理安全技术及配套的管理体系来防止您的信息被泄露、毁损或者丢失。我们【讯小通】APP采用严格的数据访问权限控制和多重身份认证技术保护个人信息,避免数据被违规使用。我们不会将用户的个人数据存储在公有云上,防止您的个人信息遭到未经授权的访问使用、修改,避免数据的损坏或丢失。

② 讯小通重视个人数据的安全。我们采用适当的物理、管理和技术保障措施来保护您的个人数据不被未经授权访问、披露、使用、修改、损坏或丢失。例如,我们会使用加密技术确保数据的机密性;我们会使用保护机制防止数据遭到恶意攻击;我们会部署访问控制机制,确保只有授权人员才可访问个人数据;以及我们会举办安全和隐私保护培训课程,加强员工对于保护个人数据重要性的认识。我们将会在达成本政策所述目的所需的期限内保留您的个人数据,除非需要延长保留期或受到法律的允许。我们会尽力保护您的个人数据,但是请注意任何安全措施都无法做到无懈可击;

③ 尽管有前述安全措施,但妥善保管您的账户及密码及其他信息的安全是您的责任和义务,因您未能保管好账户和密码而导致的法律责任由您全部承担;

④ 如果发现您账号或密码被他人非法使用或有使用异常的情况的,应及时通知讯小通,您可要求讯小通采取措施暂停您账户的登录和使用。

3.人员管理

我们定期会举办安全和隐私保护培训课程,加强员工对于保护个人信息重要性的认识。我们仅允许有必要知晓这些信息的员工访问信息,并为此设置了严格的访问权限控制和监控机制。我们同时要求可能接触到您个人信息的所有人员履行相应的保密义务,该人员如未能履行保密义务,将会被追究责任。

4.应急预案

如不幸发生个人信息安全事件,我们将按照法律法规的要求,采取合理方式及时向受影响的用户告知安全事件的相关情况,并按照监管部门要求,主动上报个人信息安全事件的处置情况。

(三)互联网环境并非绝对安全的环境,我们将尽力确保或担保您发送给我们的任何个人信息的安全性。但请您理解,由于技术水平限制及可能存在的各种恶意手段,实践中我们对您的信息保护仍然可能因我们可控制范围外的因素而存在不确定性。

(四)如我们停止运营,我们将及时停止收集您个人信息的活动,且对所持有的个人信息进行删除或匿名化处理,但因法律法规、监管规定、自律规则另有规定的除外。

四、我们如何委托处理、共享、转让和公开披露您的个人信息

(一)委托处理

为了向您提供更完善、优质的我们产品与/或服务,某些功能(例如:消息)由我们的技术服务供应商(例如:vivo,OPPO,华为,小米)提供,我们可能会委托供应商处理您的某些个人信息。您可点击此处查看讯小通与第三方技术服务商合作情况说明。对我们委托处理您个人信息的公司、组织和个人,我们会与其签署严格的保密协议,明确双方责任、处理事项、处理期限、处理性质和处理目的,要求他们仅按照我们的要求、本政策以及其他任何相关的保密和安全措施来处理个人信息。如果您拒绝我们的供应商在提供服务时收集为提供服务所必需的个人信息,将可能导致您无法使用我们产品与/或服务来享用该供应商提供的服务。

(二)共享

我们承诺对您的个人信息进行保密。除本政策及法律法规另有规定外,我们仅在下列任一情形下与我们的关联公司、我们的供应商或合作伙伴共享您的个人信息。我们的供应商包括提供技术服务,电信业务等机构(前述我们的关联公司、供应商及合作伙伴合称“第三方”)。在与第三方开展合作前,我们会尽商业上的合理努力对该第三方的安全能力进行检测,评估其采集信息的正当性、合法性与必要性:

1.在获取您同意的情况下与第三方共享您的个人信息。

2.请您知悉:该共享的合作方为数据控制者,以其自己的名义获得您的同意已处理您的个人信息。合作方可能有其独立的隐私政策和用户协议,我们建议您认真阅读并遵守第三方的用户协议及隐私政策。如果您拒绝我们的合作方在提供服务时收集为提供服务所必需的个人信息,将可能导致您无法使用我们产品与/或服务来享用该合作方提供的服务,目前,我们向业务合作方共享您个人信息的情形包括:

实名认证服务提供方:我们会将您的身份证照片提供给实名认证的合作方,由该合作方提供的身份验证服务来完成实名认证,以更好地提升账号开通及后续活动的安全性;

第三方SDK合作伙伴:关于第三方SDK合作伙伴的身份、收集个人信息的目的、方式、范围情况,您可点击此处查看讯小通与第三方数据合作情况说明

4.为遵守适用的法律法规及监管规定、维护社会公共利益,保护我们的客户、我们【讯小通】APP或我们员工的人身、财产安全或其他合法权益所必须的合理用途。

5.根据法律规定及合理的商业习惯,在我们计划与其他公司合并、被其收购或进行其他资本市场活动而需要接受来自其他主体的尽职调查时,我们可能会将您的信息提供给必要的调查主体。在前述情形下,我们会通过与该调查主体签署保密协议方式要求其对您的个人信息采取合理的保密措施。

6.在您授权第三方向我们查询、采集您在我们【讯小通】APP的信息的前提下,在法律法规允许范围内及您的授权范围内向第三方共享您的信息。

我们为了实现【讯小通消息推送】服务,我们集成【vivo、华为、OPPO、小米推送SDK】,收集个人信息的目的在于实现vivo、华为、OPPO、小米推送基本的消息推送服务,并且保证我们遵守适用的相关法律、法规及其他规范性文件。您有权自行选择是否提供该信息,但多数情况下,如果您不提供,我们可能无法向您提供相应的服务,也无法回应您遇到的问题。这些信息包括:

① 为将第三方应用提供的相关的信息及时推送到您的设备终端,我们会收集您的设备标识OAID和加密的Android ID,以及使用推送服务的应用信息如应用包名、版本号和运行状态。

② 为针对您的设备和系统等向您推送和展示消息,我们还会收集设备相关信息如设备厂商、设备型号、设备内存、操作系统版本、vivo、华为、OPPO、小米推送SDK版本、设备归属地(国家或地区)、SIM卡运营商名称、当前网络类型。其中当前网络类型、SIM卡运营商名称仅在设备本地读取,不会上传至vivo、华为、OPPO、小米服务器。

③ 您可以通过更改通知栏设置来改变您接收推送消息的方式,为根据您的设置为您提供推送服务,我们会收集您的通知栏设置信息,包括是否屏蔽通知栏、是否设置锁屏弹出消息等。

④ 对于从您的各种设备上收集到的信息,我们可能会将它们进行关联,以便我们能在这些设备上为您提供一致的服务。我们会将此部分信息用于分析和开发与我们产品或服务的使用相关的统计信息,以更好地改进我们的产品或服务。

⑤ 为便于您更好地理解【vivo、华为、OPPO、小米推送SDK】个人信息收集使用规则,您可以在【讯小通共享个人信息清单】中点击隐私协议连接,查看各平台的隐私协议政策。

(三)转让

我们不会将您的个人信息转让或提供给任何公司、组织和个人,但以下情况除外:

1.该转让已事先获得您明确的同意或授权。

2.根据适用的法律法规、强制性的行政或司法要求而必须向有关部门、机构或组织提供。

3.因涉及合并、收购或破产清算而转让。在前述情形下,我们将要求新的持有您个人信息的公司、组织继续受本政策的约束,否则我们将要求该公司、组织重新向您征求授权或同意。

(四)公开披露

我们仅会在以下情况下公开披露您的个人信息:

1.获得您明确同意后。

2.基于法律的披露:在法律、法律程序、诉讼或政府主管部门强制性要求的情况下,我们可能会公开披露您的个人信息。

3.根据法律规定,共享、转让匿名化处理的个人信息,且确保数据接收方无法复原并重新识别个人信息主体的,不属于个人信息的对外共享、转让及公开披露行为,对此类数据的保存及处理将无需另行向您通知并征得您的同意。

(五)个人信息存储期限

我们承诺在法律规定的最短期限内存储您的个人信息。

(六)个人信息超期处理

在您的个人信息超出保留期限后,我们会根据适用法律的要求删除您的个人信息,或使其匿名化处理。

五、您的权利

按照中国相关的法律、法规、标准,以及其他国家、地区的通行做法,我们保障您对自己的个人信息行使以下权利:

(一)访问您的个人信息

您可以通过“我的-账号信息”进入账号管理页面,在账号管理页面内可以查询APP个人账号。您也可以联系我们的客服热线,咨询相关问题。

(二)更正您的个人信息

您可以通过“我的-账号信息” 进入账号管理页面,在该页面您可以修改昵称、头像。您也可以联系我们的客服热线,咨询相关问题。

您可以通过“我的-通用设置” 进入设置页面,在该页面您可以永久注册账号。您也可以联系我们的客服热线,咨询相关问题。

(三)删除您的个人信息

在以下情形中,您可以向我们提出删除个人信息的请求:

1.如果我们处理个人信息的行为违反法律法规。

2.如果我们收集,使用您的个人信息,却未征得您的同意。

3.如果我们处理个人信息的行为违反了与您的约定。

4.如果您不再使用我们的产品或服务,或您注销了账号。

5.如果我们不再为您提供产品或服务。

我们将及时、合理地响应您的删除请求,但因法律法规、监管规定、自律规则另有规定的除外。当您从我们的服务中删除信息后,我们可能不会立即从备份系统中删除相应的信息,但会在备份更新时删除这些信息。

(四)更改您授权同意的范围

请您知悉,为了您正常使用我们【讯小通】APP产品与/或服务,您需要向我们提供一些基本的个人信息。如果您希望撤回先前同意开启的相关权限,您可以打开手机系统设置,在应用设置中关闭相应的权限。如果您希望更改或撤回其他已经您授权的同意,您可以通过我的->通用设置->个人信息与权限->撤回个人隐私政策同意或本政策提供的联系方式联系我们修改。

当您更改您的同意范围后,我们将不再收集和使用您相应的个人信息,但请您理解,在您更改您的同意范围后,我们无法再为您提供与之对应的我们【讯小通】APP产品或/与服务。您在此同意,您更改同意范围或撤回同意的行为不会影响我们基于您之前授权对您个人信息的处理和存储。

(五)个人信息主体注销账户

您随时可注销此前注册的账户。在注销账户之后,我们将停止为您提供产品或服务,并依据您的要求,删除您的个人信息,但法律法规、监管规定、自律规则另有规定的除外,您在使用本行服务期间提供或产生的信息我们仍需按照监管要求的时间进行保存,且在该保存的时间内依法配合有关机关的查询。

如出现未及时响应用户相应操作的,需人工处理的,我司在15个工作日内完成核查和处理。

您有权随时注销您的账户,具体包括我们【讯小通】APP新老版本个人账号等。

涉及个人账号注销后您在我们【讯小通】APP不可恢复的权益与系统设置如下:

1.我们【讯小通】APP账号设置:个人设置(头像、昵称)

2.其他与账号相关的数据信息。

(六)响应您的上述请求

对于您合理的请求,我们原则上不收取费用,对于那些无端重复、需要过多技术手段(例如,需要开发新系统或从根本上改变现行惯例)、给他人合法权益带来风险或者非常不切实际(例如,涉及备份磁带上存放的信息)的请求,我们可能会予以拒绝。

在以下情形中,我们将无法响应您的请求:

1.与个人信息控制者履行法律法规规定的义务相关的。

2.与国家安全、国防安全直接相关的。

3.与公共安全、公共卫生、重大公共利益直接相关的。

4.与刑事侦查、起诉、审判和执行判决直接相关的。

请您注意,您的交易相对方、您访问的第三方网站经营者、通过我们接入的第三方服务或自我们【讯小通】APP处接收您的个人信息的第三方可能制订自己的隐私权保护政策;当您查看第三方创建的网页或使用第三方开发的应用程序时,该第三方可能会放置其自身的Cookie或像素标签,此类Cookie或标签不受我们的控制,且其使用不受本政策的约束。在此,我们建议您与其直接联系以了解其隐私权政策的详细情况。如您发现该第三方创建的网页或第三方开发的应用程序存在风险,建议您终止相关操作以保护您的合法权益。

七、未成年人的个人信息保护

1.我们非常重视对未成年人个人信息的保护。若您是14周岁以下的未成年人,在使用我们的产品与/或服务前,应事先取得您监护人的同意。我们根据国家相关法律法规的规定保护未成年人的个人信息。

2.我们不会主动直接向未成年人收集其个人信息。对于经监护人同意而收集未成年人个人信息的情况,我们只会在受到法律允许、监护人同意或者保护未成年人所必要的情况下使用、共享、转让或披露此信息。

本政策所稱個人訊息,是以電子或其他方式記錄的與已識別或可識別的自然人有關的各種信息,不包括匿名化處理後的信息。我們【訊小通】APP中與您個人無關的資訊不屬於您的個人資訊。

本政策所稱個人敏感信息,是指一旦洩露、非法提供或濫用可能危害人身和財產安全,極易導致個人名譽、身心健康受到損害或歧視性待遇的個人信息: 個人財產資訊(銀行帳戶、資金及存款資訊、資產資訊、信貸資訊、徵信資訊、交易記錄、流水記錄、虛擬財產資訊)、個人健康生理資訊(生病醫治相關記錄)、個人生物辨識資訊(基因、指紋、臉部辨識特徵)、個人識別資訊(身分證資訊、護照資訊、工作證資訊),以及其他符合上述特徵的個人敏感資訊(通訊紀錄、通訊錄、精準位置資訊)。

為使您正常使用我們【訊小通】APP服務,我們需要依照相關法規要求進行實名管理。我們收集、儲存、使用及分享您的個人信息,係出於遵守國家法律法規的規定,並為了向您提供服務及提升服務品質(如開發新產品或完善已有產品功能,以為您提供和推薦更為優質或適合的服務)的需要。

我們將嚴格依照《網路安全法》、《資料安全法》、《個人資訊保護法》等相關要求,做好對客戶資訊收集、記錄、儲存及報送工作。

一、我們為何收集您的個人資料

(一)收集並保存的資訊

我們收集並保存的您的個人資訊包括:

1.您註冊、登入手機號碼、登入IP位址、手機IMEI碼、版本、裝置識別碼、裝置識別、登入日誌。

2.您的使用記錄,包括您的搜尋記錄、套用版本資訊、您的剪切板資料及其他相關日誌資訊。

3.您主動提供的信息,包括您在我們【訊小通】APP主動發布的信息、您與客服聯繫時提供的信息、您參與問卷調查時填寫的信息、您參與平台活動提供的信息、您使用平台填寫相關申請提供的資料。

4.當您在使用我們的訊小通即時通訊服務時,因本APP為公司內部研發,僅為員工公司內部工作溝通交流使用,且僅允許發送工作相關內容,不允許運用於私人聊天等,為了增強公司資訊安全,以免洩漏公司重要資訊(例如新產品設計等),其所有聊天記錄將會被記錄盤,以備本公司權限人員查詢或本公司客戶權限人員查詢。

5.我們在收集、使用您個人資訊的過程中遵循權責一致、目的明確、選擇同意、最少夠用、公開透明、確保安全及主體參與原則。

6.訊小通透過合法途徑從商業夥伴或第三方取得的資料。例如在法律允許的情況下,我們會從公用和商用第三方來源取得有關資料來支援我們的服務;

7.個人常用裝置資訊(包括裝置序號、硬體型號、裝置MAC位址、作業系統類型、應用程式清單(應用程式名稱、應用程式套件名稱、安裝時間)及行程資訊、唯一裝置識別碼IMEI/ AndroidId /OAID/IDFA/ OPENUDID/GUID 、 SIM卡IMSI資訊等在內的描述個人常用設備基本情況的資訊);個人位置資訊(包括行程資訊、精準定位資訊、經緯度、 IP位址、 WLAN熱點、基地台資訊、藍牙設備以及其他能夠用於定位的感測器資訊等);個人設備權限資訊(包括相簿、相機、麥克風、通訊錄、日曆等資訊)。

8.通常情況下,您不需要提供個人資料就可以瀏覽訊小通的對外公開資訊。為了提供您服務,訊小通會依照本隱私權政策的規定保護、使用和揭露您的個人資料。為服務之目的,如果您以自願填寫的方式或根據要求提供所需的個人信息,例如姓名、性別、證件種類及證件號、出生年月日、國籍、電子郵件信箱、電話、聯絡地址和郵政編碼、所希望提供的服務或喜好資訊、客戶代碼以及其他類似的個人數據,則表示您已經了解並接受訊小通依照本隱私權政策對您的個人資料的收集、保護和使用。

我們收集並保存的您的非個人資訊包括:

1.在使用我們提供的服務時您所發佈、公佈的資訊;

2.訊小通已對您採取的包括但不限於違反法律法規規定或違反訊小通政策的處理措施等相關資訊;

我們會盡力隔離您的個人資料和非識別性數據,並單獨使用這兩種數據。如果個人資料摻雜了非識別性數據,依舊會被視為個人資料處理。

未經訊小通事先同意,您不應向我們提供訊小通未明確要求的、可能致使訊小通在本政策之外被附加額外法律義務的個人信息。

為您提供安全保障

為了保障您的帳號安全,以及系統運作安全,滿足法律法規和我們協議規則相關要求,在您存取及使用我們的產品/服務過程中,經您授權我們會取得您的裝置信息,包括您使用的裝置型號、硬體序號、裝置MAC位址、 IMEI 、 Android ID 、 GUID 、 SIM卡IMSI 、行動應用程式清單、電信業者特性資訊。未經您的授權,我們不會事先取得以上資訊。

為提高您使用我們提供服務的安全性,更準確的預防釣魚網站欺詐和木馬病毒,我們會使用或整合您的個人資訊以及我們的關聯方、合作夥伴取得您授權或依法分享訊息,根據您的使用習慣和常用軟體資訊來綜合判斷您的帳號交易風險,包括驗證身分、預防、發現、調查可能存在的詐欺、網路病毒、網路攻擊安全風險。以保護您、其他使用者、我們或關聯方的合法權益。

(二)收集的目的

基於下列原因的考慮,我們收集並使用您的個人信息,您主動提供相關信息或要求您提供相關信息。前述資訊的來源包括:您透過我們【訊小通】APP或其他合法途徑向我們提供的資訊;您自行向社會公眾公開的資訊;您透過合法公開的管道(如合法的新聞報告、政府資訊公開)揭露或合法留存於第三方的資訊。

1.為方便您註冊、登入、使用我們【訊小通】APP的各項服務

① 當您註冊、登入我們【訊小通】APP及使用相關服務時,您可以透過手機號碼建立帳號,並且您可以完善相關的網路識別資訊(頭像、暱稱、密碼),收集這些資訊是為了幫助您完成註冊並使用相關服務。

② 當您使用我們【訊小通】APP推送服務,應用更新功能時, APP會開啟自啟動權限,若您不授權,不影響您其他功能。

③ 基於我們與通訊業者的合作,當您使用我們【訊小通】APP的「註冊/登入」功能時,經過您的同意,我們會透過您的手機號碼向通訊業者授權的第三方提交認證,以便我們為您提供快速的登入服務。如果您拒絕提供將無法使用「註冊/登入」方式註冊登入我們【訊小通】APP,但不影響您透過其他方式註冊登錄,也不影響其他功能的正常使用。

④ 進行內部稽核、數據分析和研究,改善我們的產品和服務。

⑤ 改善我們的防損和反詐騙計畫

⑥ 遵從和執行適用的法律法規要求,相關的行業標準或我們的政策

⑦ 其它為向您提供服務而需要使用您個人資料的情形

2.風險防範

為了防止您個人資訊及其他重要資訊或資料被不法分子獲取,我們需要收集您的下列資訊以判斷您帳戶的風險:當您造訪我們【訊小通】APP時,我們可能會記錄您使用的服務類別和方式、使用服務時的操作訊息,您的IP位址、所使用的軟體版本、裝置識別碼、裝置識別碼、您的地理位置及/或其他與我們【訊小通】APP服務相關的日誌資訊。如您選擇關閉收集位置功能,我們將停止對您的位置資訊的收集;這樣做不會影響您進行交易,但可能會影響我們對安全狀況的判斷效果。

3.提供服務狀態通知及查詢服務

在遵守相關法律法規及監管規定前提下,我們會將您使用我們【訊小通】APP服務時的身份資訊、行為資訊進行存檔,並嚴格按照法律法規的規定對前述資訊妥善保管。為使您知曉使用我們【訊小通】APP服務的狀態,我們會根據相關資訊向您發送服務狀態通知。

4.法律法規、監管規定允許的其他用途。

5.其他情形

在法律法規允許的範圍內,我們可能會在出現以下任一情形時收集並使用您的個人資訊而無需徵得您的授權同意:

① 與國家安全、國防安全直接相關的;

② 與公共安全、公共衛生、重大公共利益直接相關的;

③ 與犯罪偵查、起訴、審判和判決執行直接相關的;

④ 出於維護個人資訊主體或其他個人的生命、財產重大合法權益但又很難得到本人同意的;

⑤ 所收集的個人資訊是個人資訊主體自行向社會公眾公開的;

⑥ 從合法公開揭露的資訊中收集個人資訊的,如合法的新聞報告、政府資訊公開管道;

⑦ 根據個人資訊主體要求簽訂和履行合約所必需的;

⑧ 用於維護所提供的產品或服務的安全穩定運作所必需的,例如發現、處置產品或服務的故障;

⑨ 個人資訊控制者為新聞單位且其在進行合法的新聞報道所必需的;

⑩ 法令規定的其他情形。

二、我們如何使用您的個人資訊

1.未經您事先同意,【訊小通】APP承諾不會出售您的個人資料。訊小通會在法律允許的範圍內根據本政策使用您提供的個人資料。但訊小通可能會根據法律法規、司法機構、執法機構、監管機構或政府部門的要求向這些部門提供您的個人資料;或在訴訟、仲裁等法律或爭議解決程序中披露;或在訊小通有理由認為有必要這樣做來保護訊小通、客戶或公眾利益時,也可能在盡可能小的範圍內公開某些個人資料。當您提供個人資料時,您瞭解並同意訊小通將在某些情形中使用或向第三方提供您的個人數據,包含但不限於如下情形:

① 根據法律法規的相關規定,或應行政或司法執法及監管機構的要求,向第三方或行政機關、司法機構、執法機構或監管機構揭露;

② 如您出現違反所適用的法律、法規或訊小通服務協議或相關政策的情況,需要向第三方揭露;

③ 為向您提供或因您使用您所訂購或要求的產品和服務,而需要向第三方披露;

④ 其它訊小通根據法律、法規或網站政策認為適當的揭露,例如出於執行條款與條件或為阻止人身、財產損失或非法行為的目的;

⑤ 除非得到您的許可,或本政策約定的其它情形,或因該第三方作為訊小通的服務提供者/分包商/授權中心向您提供服務,訊小通不會向無關第三方提供、出售或出租您的個人資料。

⑥ 在某些管轄區,如果涉及重組、合併或破產或清算,可能需要揭露您的個人資料;

⑦ 網路連結資訊可能被用於網路攻擊偵測;

⑧ 在訴訟、仲裁等法律或爭議解決程序中。

⑨ 在有公司資訊安全事件的情況下,我們可能需要向監管單位(含客戶、政府機關等)提供聊天記錄,這可能會涉及到揭露您的部分個人資料。我們將確保在符合相關法律法規的前提下,謹慎處理此類請求,並盡最大努力保護您的隱私權益。

三、我們如何儲存及保護您的個人資訊

(一)我們在中華人民共和國境內收集和產生的個人資訊將儲存在中華人民共和國境內。若為處理跨境業務且經您授權而向境外機構傳輸境內收集的相關個人資訊的,我們會按照法律、行政法規和相關監管部門的規定執行,並透過簽訂協議有效措施要求境外機構為所獲得的個人資料保密。

(二)我們承諾將按照業內成熟的安全標準,採取相應的安全措施使資訊安全保護達到合理的安全水平,並從制度設置、技術措施、人員管理多方面保障您的資訊安全。

1.制度設定

我們透過建立資料分類分級制度、資料安全管理規範來管理規範個人資訊的儲存和使用,並建立資訊保護專職崗位、資料安全應變組織來推進和保障個人資訊安全。

2.技術措施

① 我們致力於使用各種網路安全層軟體( SSL )進行加密傳輸、資訊加密儲存、嚴格限制資料中心的存取、使用專用網路通道及網路代理安全技術及配套的管理系統來防止您的資訊外洩、毀損或遺失。我們【訊小通】APP採用嚴格的資料存取權限控制和多重身分認證技術保護個人資訊,避免資料被違規使用。我們不會將使用者的個人資料儲存在公有雲上,防止您的個人資訊遭到未經授權的存取使用、修改,避免資料的損壞或遺失。

② 訊小通重視個人資料的安全。我們採用適當的實體、管理和技術保障措施來保護您的個人資料不被未經授權存取、揭露、使用、修改、損壞或遺失。例如,我們會使用加密技術確保資料的機密性;我們會使用保護機制來防止資料遭到惡意攻擊;我們會部署存取控制機制,確保只有授權人員才能存取個人資料;以及我們會舉辦安全和隱私保護培訓課程,加強員工對於保護個人資料重要性的認知。我們將會在達成本政策所述目的所需的期限內保留您的個人數據,除非需要延長保留期或受到法律的允許。我們會盡力保護您的個人數據,但是請注意任何安全措施都無法做到無懈可擊;

③ 儘管有前述安全措施,但妥善保管您的帳戶及密碼及其他資訊的安全是您的責任和義務,因您未能保管好帳戶和密碼而導致的法律責任由您全部承擔;

④ 如果發現您帳號或密碼被他人非法使用或有使用異常的情況的,應及時通知訊小通,您可要求訊小通採取措施暫停您帳戶的登入和使用。

3.人員管理

我們定期舉辦安全與隱私權保護訓練課程,加強員工對於保護個人資訊重要性的認知。我們僅允許有必要知曉這些資訊的員工存取信息,並為此設置了嚴格的存取權限控制和監控機制。我們同時要求所有可能接觸到您個人資訊的人員履行相應的保密義務,該人員如未能履行保密義務,將會被追究責任。

4.緊急應變計畫

如不幸發生個人資訊安全事件,我們將按照法律法規的要求,採取合理方式及時向受影響的用戶告知安全事件的相關情況,並按照監管部門要求,主動上報個人資訊安全事件的處置情況。

(三)網路環境並非絕對安全的環境,我們將盡力確保或擔保您發送給我們的任何個人資訊的安全性。但請您瞭解,由於技術水平限制及可能存在的各種惡意手段,實務上我們對您的資訊保護仍可能因我們可控制範圍外的因素而存在不確定性。

(四)如我們停止運營,我們將及時停止收集您個人資訊的活動,且對所持有的個人資訊進行刪除或匿名化處理,但因法律法規、監管規定、自律規則另有規定的除外。

四、我們如何委託處理、分享、轉讓和公開揭露您的個人資訊

(一)委託處理

為了提供您更完善、優質的我們產品與/或服務,某些功能(例如:訊息)由我們的技術服務供應商(例如: vivo , OPPO ,華為,小米)提供,我們可能會委託供應商處理您的某些個人資訊。 您可點此查看訊小通與第三方技術服務商合作情況說明。對我們委託處理您個人資訊的公司、組織和個人,我們會與其簽署嚴格的保密協議,明確雙方責任、處理事項、處理期限、處理性質和處理目的,要求他們僅按照我們的要求、本政策以及其他任何相關的保密和安全措施來處理個人資訊。如果您拒絕我們的供應商在提供服務時收集為提供服務所需的個人信息,將可能導致您無法使用我們產品與/或服務來享用該供應商提供的服務。

(二)共享

我們承諾對您的個人資訊保密。除本政策及法令另有規定外,我們僅在下列任一情形下與我們的關聯公司、我們的供應商或合作夥伴分享您的個人資訊。我們的供應商包括提供技術服務,電信業務等機構(前述我們的關聯公司、供應商及合作夥伴合稱「第三方」)。在與第三方合作前,我們會盡商業上的合理努力對該第三方的安全能力進行檢測,評估其採集資訊的正當性、合法性與必要性:

1.在取得您同意的情況下與第三方分享您的個人資訊。

2.請您知悉:該共享的合作方為資料控制者,以其自己的名義取得您的同意已處理您的個人資訊。 合作者可能有其獨立的隱私權政策和使用者協議,我們建議您認真閱讀並遵守第三方的使用者協議及隱私權政策。如果您拒絕我們的合作方在提供服務時收集為提供服務所必需的個人信息,將可能導致您無法使用我們產品與/或服務來享用該合作方提供的服務,目前,我們向業務合作方分享您個人資訊的情形包括:

實名認證服務提供者:我們會將您的身分證照片提供給實名認證的合作方,由該合作方提供的驗證服務來完成實名認證,以便更好地提升帳號開通及後續活動的安全性;

第三方SDK合作夥伴:關於第三方SDK合作夥伴的身份、收集個人資訊的目的、方式、範圍情況, 您可點此查看訊小通與第三方資料合作說明

4.為遵守適用的法律法規及監管規定、維護社會公共利益,保護我們的客戶、我們【訊小通】APP或我們員工的人身、財產安全或其他合法權益所必須的合理用途。

5.根據法律規定及合理的商業習慣,當我們計劃與其他公司合併、被其收購或進行其他資本市場活動而需要接受來自其他主體的盡職調查時,我們可能會將您的資訊提供給必要的調查主體。在前述情形下,我們會透過與該調查主體簽署保密協議方式要求其對您的個人資訊採取合理的保密措施。

6.在您授權第三方向我們查詢、收集您在我們【訊小通】APP的資訊的前提下,在法律法規允許範圍內及您的授權範圍內向第三方共享您的資訊。

我們為了實現【訊小通訊息推送】服務,我們整合【 vivo 、華為、 OPPO 、小米推送SDK 】,收集個人資訊的目的在於實現vivo 、華為、 OPPO 、小米推播基本的訊息推播服務,並且保證我們遵守適用的相關法律、法規及其他規範性文件。您有權自行選擇是否提供該信息,但多數情況下,如果您不提供,我們可能無法向您提供相應的服務,也無法回應您遇到的問題。這些資訊包括:

在下列情形中,您可以向我們提出刪除個人資訊的請求:

當您更改您的同意範圍後,我們將不再收集和使用您相應的個人信息,但請您理解,在您更改您的同意範圍後,我們無法再為您提供與之對應的我們【訊小通】APP產品或/與服務。您在此同意,您更改同意範圍或撤回同意的行為不會影響我們基於您先前授權對您個人資訊的處理和儲存。

(五)個人資訊主體註銷帳號

您隨時可登出先前註冊的帳戶。在註銷帳戶之後,我們將停止為您提供產品或服務,並依據您的要求,刪除您的個人信息,但法律法規、監管規定、自律規則另有規定的除外,您在使用本行服務期間提供或產生的資訊我們仍需依照監管要求的時間保存,且在該保存的時間內依法配合有關機關的查詢。
